INTERNATIONAL ARBITRATION

Toby Cadman.

04

Extradition, Interpol & MLA

Toby has practised in extradition from both sides. He served as a Senior Crown Prosecutor for Extradition in England and Wales, and now acts principally for requested persons, in the UK and in cross-border matters elsewhere, where a request raises questions of fair trial, prison conditions, abuse of process or political motive.

A significant part of this practice concerns INTERPOL. He brings applications to the Commission for the Control of INTERPOL's Files for the deletion of Red Notices and diffusions, and for access to and correction of data, where a member state is using INTERPOL's channels to pursue political opponents, journalists, business rivals or dissidents. Those applications turn on Articles 2 and 3 of INTERPOL's Constitution, its Rules on the Processing of Data, and close analysis of the proceedings in the requesting state.

He also advises on mutual legal assistance, cross-border evidence-gathering, and asset freezing and recovery requests. Because these matters so often run alongside criminal proceedings abroad, sanctions or immigration consequences, he coordinates the response across jurisdictions rather than treating each as a separate problem.
